OVERVIEW

Welcome to The Welcoming Porch (“we,” “us,” “our”). We operate this website and store, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy and Refund/Returns Policy), describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

SECTION 1 – ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your state or province of residence and that you have authority to agree to these Terms.

To use the Services (including browsing or purchasing), you may be asked to provide certain information (e.g., email, billing/payment, service address). You agree that all information you provide is accurate, current, and complete and that you have all rights necessary to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account.

SECTION 2 – OUR PRODUCTS & SERVICES (RENTALS)

We are a local porch décor rental and styling service. Product photos, mockups, and examples are for inspiration; actual items may vary by season and inventory. Colors and appearance may differ due to device settings and lighting.

Descriptions, availability, and configurations are subject to change without notice. We may discontinue items or limit quantities or service availability to any person, geographic region, or jurisdiction.

SECTION 3 – ORDERS & SCHEDULING

Placing an order is an offer to purchase. We may accept or decline any order at our discretion. Acceptance occurs when we confirm your order and schedule delivery/installation. We must successfully process your payment prior to acceptance.

Orders may include one-time seasonal setups or subscriptions (e.g., annual plans with seasonal refreshes). You agree to provide accurate service location information and be available (or provide access) at the scheduled time.

Your purchases are subject to our Refund/Returns Policy. For clarity: we do not offer monetary refunds for rentals or subscriptions except as expressly stated in that policy (e.g., moving outside our service area with prepaid annual plans).

SECTION 4 – PRICES, BILLING & AUTHORIZATIONS

Prices, discounts, and promotions may change without notice. The price in effect at checkout applies and will be shown on your order confirmation. Posted prices typically exclude taxes and any optional on-site installation fees (if applicable).

You agree to provide current, complete, and accurate purchase and account information (including valid payment method and billing details) and to promptly update them as needed.

By purchasing, you: (i) authorize us and Shopify to charge your payment method for your order and applicable taxes/fees; and (ii) authorize reasonable post-service charges for missing or severely damaged rental items per Section 7 (Rental Care & Damages) when applicable.

SECTION 5 – LOCAL DELIVERY, INSTALLATION & PICKUP (NO SHIPPING)

We operate locally (West Michigan). We deliver/install décor on-site and pick up totes/items at the end of the rental or when swaps are approved. We do not require you to ship items and we do not provide return shipping labels.

Delivery/installation and pickup times are estimates and may be affected by weather, access, safety, and other conditions beyond our control. We will communicate promptly if a reschedule is needed.

Service Area: Barry County, MI and adjacent counties (Eaton, Kent, Ionia, Allegan, Calhoun). Requests outside this area may be declined or may incur additional fees by prior agreement only.

SECTION 6 – INTELLECTUAL PROPERTY

All content and materials on the Services (including trademarks, logos, text, images, graphics, audio/video, and their design/arrangement) are owned by The Welcoming Porch or its licensors and are protected by applicable laws. You may use the Services for personal, non-commercial purposes only.

You may not copy, reproduce, distribute, modify, create derivative works, publicly display/perform, republish, download, store, or transmit any materials without our prior written consent, except as permitted by law. All rights not expressly granted are reserved.

Our names, logos, product/service names, designs, and slogans are our trademarks. Shopify’s names and marks are trademarks of Shopify. Other marks belong to their respective owners.

SECTION 7 – RENTAL CARE, DAMAGES & SWAPS

You agree to take reasonable care of rental items and keep them protected from excessive moisture, wind, heat sources, open flame, and other hazards. Normal wear is expected.

Damages/Missing Items: If items are returned missing or severely damaged (beyond normal wear), you authorize us to charge a reasonable replacement or repair fee to your payment method on file. We will notify you of any assessed fee.
Swaps/Adjustments (within 30 days): If something doesn’t fit your style, you may request a swap or adjustment within 30 days of your setup date, subject to current inventory and seasonal availability. Email Myporchstyle@gmail.com to request; once approved, we will schedule pickup/replacement.
No Returns/Refunds: We do not accept returns for a refund on rentals. Prepaid annual subscriptions are non-refundable, except if you move outside our service area; in that case, we will refund the unused portion of your annual plan.

SECTION 8 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms. Future features may also be subject to these Terms.

SECTION 9 – THIRD-PARTY LINKS

The Services may contain links to third-party websites or content. We are not responsible for examining, evaluating, or warranting third-party materials and are not liable for any harm or damages related to your use of them. Review third-party policies before engaging in any transaction.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

The Services are powered by Shopify. However, your sales and rentals are with The Welcoming Porch, not Shopify. Shopify is not responsible for your purchases, and you release Shopify from any claims arising from your transactions with us.

SECTION 11 – PRIVACY

Personal information collected through the Services is governed by our Privacy Policy and, where applicable, Shopify’s Privacy Policy. Because the Services are hosted by Shopify, certain data may be processed outside your country in accordance with their policies.

SECTION 12 – FEEDBACK & REVIEWS

If you submit feedback, ideas, reviews, or suggestions (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use and display such Feedback for any purpose, including to operate and improve the Services. You represent you have the necessary rights to grant this license and that your Feedback complies with applicable law and these Terms. We may remove content we deem unlawful, infringing, or objectionable.

SECTION 13 – ERRORS, INACCURACIES & OMISSIONS

Occasionally information on the Services may contain typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, availability). We reserve the right to correct or update information and to cancel orders if any information is inaccurate, at any time and without notice.

SECTION 14 – PROHIBITED USES

You may use the Services only for lawful purposes and in accordance with these Terms. Prohibited uses include, without limitation: illegal acts; infringing IP rights; harassment or abuse; transmitting malware; scraping; spamming; impersonation; or interfering with site security. We may suspend or terminate access for violations.

SECTION 15 – TERMINATION

We may terminate or suspend your access to the Services at any time, with or without notice. You remain responsible for amounts due up to and including the date of termination. Sections intended to survive termination shall do so.

SECTION 16 – DISCLAIMER OF WARRANTIES

Except as expressly stated by The Welcoming Porch, the Services and all products/rentals are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow disclaimers; some rights may not apply to you.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Welcoming Porch and our owners, partners, officers, employees, agents, contractors, service providers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, revenue, savings, data, or replacement costs) arising from or related to your use of the Services or any product/rental, even if advised of the possibility.

SECTION 18 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Welcoming Porch and our affiliates, officers, employees, agents, contractors, and service providers (and Shopify and its affiliates) from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or misuse of the Services.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any right or provision is not a waiver. These Terms, together with policies posted on the site, constitute the entire agreement between you and us and supersede prior communications regarding the Services.

SECTION 21 – ASSIGNMENT

You may not assign or transfer these Terms or any rights or obligations without our prior written consent. We may assign or transfer these Terms without restriction.

SECTION 22 – GOVERNING LAW & VENUE

These Terms and any disputes arising from them are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. You and The Welcoming Porch consent to exclusive jurisdiction and venue in the state and federal courts located in Barry County, Michigan (or the nearest competent Michigan court).

Headings are for convenience only and do not affect interpretation.

You can review the most current version of these Terms at any time on this page. We may update these Terms by posting changes to the site. Material changes will be notified as required by law. Your continued use of the Services after changes are posted constitutes acceptance.
